Shipping and Delivery

When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Delivery of larger items such as treadmills, ellipticals and weight machines in the radius of 50 km is done by our hired delivery company who carry their own insurance for any damages incurred should there be any. Anything outside of this radius shall be done by an LTL company and they shall only deliver to doorstep.
    If there is any Free Shipping on product it will only be based upon shipping within the radius specified and any additional costs shall be incurred by the purchaser at the time of purchase. In other words there will be a percentage of the delivery costs deducted to cover shipping charges. The additional costs shall be given to purchaser in a timely manner once obtained from freight carrier. Time frames of delivery shall be related to customer once obtained from freight company and a tracking number shall be issued to customer at that time.
  • Smaller packages shall be shipped using any number of carriers of which have the best time frame and costs of delivery. We use E-shipper for most smaller packages. The cost of shipping shall be included in the purchase price once obtained from the shipper and included under shipping. Time frame of delivery shall be given to customer with tracking number once obtained from carrier.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You will be responsible for paying your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

If you are shipping an item valued at over $75, you should consider a trackable shipping service or purchasing insurance. We don’t guarantee that we will receive your returned item.

If you purchase goods from us for delivery to a destination outside Canada your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Refunds

Refunds for Goods

Refund requests must be made within 14 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Good is broken;
  • Good is the wrong size; or
  • Goods are damaged.
Refunds do not apply to the following goods:
  • Items that are exempt from return are as follows:
    Wearable items including but not limited to Lifting belts, Heart Rate/ Activity monitors, Clothing, Weighted vests, Gloves/wraps/wrist supports.
  • Rubber Resistance products unless unopened such as resistance bands.
  • Any Books, CD’s or DVD’s; and
  • Any Sale product or final clearance items.

Refunds for Services

We provide refunds for services sold on our Site as follows:
  • When requesting a refund you will need to contact us with the details and reasons for refund request. We will then request return of your product for inspection. Upon receiving your returned item we will send you an email to notify you that we have received your item. If you are approved, then your refund will be processed, and a credit will be applied to your credit card or original payment method. Processing can take up to 3-5 business days, depending on your credit card provider.

Returns/Exchanges

Returns can be made in person at the following locations: At a location to be determined at time of return.

Please contact us with the details in advance by calling us a 403-942-4528 or by using the email on the website to confirm all details involved. We will then request details on the product for inspection an send an email notification for approval. If approved, the return/exchange of the product will be made and a refund issued.

Any product being returned/exchanged that has been delivered, and/or delivered and installed is subject to restocking fees. These fees range from 10%-25% of the total product(s) price being returned/exchanged. Percentage of the restocking fee will be dealt with on a case by case basis and depends on customer’s specific situation. Please contact us with all details in advance to confirm Exchanges.

We will only replace items if they are defective or damaged. If you need to exchange an item for the same item please contact us via email on the website or call us directly at 403-942-4528

Consumer Protection Law

Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability

Mark Greeno and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless Mark Greeno and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of Alberta.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
